Are manga Scanlations and anime Fansubs illegal?

Do you think manga scanlations and anime fansubs are somehow, illegal? I've got that question running on my mind for quite a while now, and I can't decide whether it is illegal or legal. I think it's illegal because it technically violates copyright and distribution rights. But if it's illegal, how come they say it's legal, and it's all over the net?

P.S. = Am I allowed to post a topic like this here? Tell me if it's not and I'll take it off immediately...I don't want to get my account frozen. ^___^;;

hm...manga i donno,but anime fansubs...illegal?i'm not so sure,but i think if the anime is not copyrighted then it is not illegal i think(correct me if i'm wrong)and about the topic thing,this is about anime afterall,so i think it should be alright(i'm in no position to say though=D)lol

There is a common misconception among the general public that copyrighting something involves a legal process of forms, money, and official certification. That simply isn't the case, in fact, an artist typicaly has to go through a legal process involving forms, money and official certification to create works that are not copyrighted to them.

The fact of the matter is, when you create something, a drawing, poem, music, the product that you create belongs to you, and belonged to you from the moment of its inception. Now, there are exceptions to this rule, when working as a group to create something, the product belongs to the group, but your contributions to the product are yours, but I don't beleive you'd be able to remove said contributions from the work after the fact. Or, if you create something at the behest of someone else, such as a commissioned painting, network anime, and so on, the legal owner and holder of the copyright to the product is the person who commisioned the work.

Anyway, to answer your question, yes, fansubs and scanlations are the illegal redistribution of copyrighted work. That being said, many fansub groups follow a sort of code of principal, claiming that as long as the people who hold the distribution rights to the product in question choose not to distribute it, they will instead provide their illegal to the populace who demand it. Likewise, when the holder of distribution rights chooses to distribute the product, or sells the rights to someone who does, fansub groups tend to discontinue.

Under this sort of system, fansub groups and the people who support them are technicaly breaking the law. However, from a greater legal standpoint it is accepted that the people demanding the product will work to aquire the product. Better that they find a free source rather than allow certain other groups financialy profit of the same illegal activity.

In english:

Fansubs and Scanlations are illegal, but the companies that translate the manga or sub the anime or whatever turn a blind eye since this helps them determine which anime/manga is popular among the fans so that they could translate/sub the manga/anime

The code is that when the anime/manga has been subbed/translated, the fansubbers/scanlators have to stop distributing the anime/manga

But some don't

Yeah i think they are illegal....but technology now a day you just can't stop them from making more and more....

It's only illegal if they catch you (heh-heh). Why pay money for it if it's free on the net? I can think of better ways to spend $30 (getting my hair done, buying clothes, anime accessories that I can't steal).
